death cert of Daniel P. Smith (at the time married to Allie, his second wife)
Hello Jennifer,
Thanks for sending along the certificates. They provided some clues.
With a little more digging, I've turned up some information that causes me to think
there are two Daniel P. Smiths.
In the 1880 census, there is a D.P. Smith and an M.J. Smith in San Antonio. D.P. is 36
(1843/4), born in N.Y., parents b. N.Y. M.J. is 25 (b 1854/5), born in Texas, father b
N.Y., m. b. Tex. D.P. owns a livery stable. This couple has four children, all b. Tex.:
Rosa 9, Austin 8, Geo. 4, Jane Anna, 2. The initials M.J., her birth year, and the birth
places of her parents fit Martha Jane Maule.
In the 1900 census, there is a Daniel P. Smith in San Antonio, b Feb 1847, age 53,
married 17 years (1882), b NY, parents b NY, wife Alice, b Jan 1857, b Texas, father b
N.C., m b Ark. Daniel is a cement dealer. This couple has four children listed, though
for Alice it states she has 8 children, of whom 5 are alive. So a child is not with the
family. The children, all b Tex.: a son, whose name is tough to read, looks like Sh_i_e,
b July 1884, age 15, Annie, Nov 1886, 13, Emma Feb 1894, 5, and Stella Jan 1897, 3.
The fifth child presumably is older, and thus presumably is born between 1882 and
1884? This definitely is the Daniel Smith for whom you have sent a death certificate,
as he is listed as a cement contractor, and his wife is named Allie (Alice). The birth
year for Daniel does not fit the birth year for the Daniel married to Martha Jane Maule.
The places of births of Alice's parents do not match the places of births of Martha
Jane Maule, so definitely Alice and Martha are different people.
In the 1910 census, Daniel the cement contractor appears, again in San Antonio. Age
63 (b 1846/7), born N.Y. parents b U.S., wife Allie, 53 (b 1856/7) b Tex. Parents b.
N.C., married 25 yrs (1884/5), 8 children, of whom 5 are alive. Three are listed with
them: Shubie 24 (b 1885/6), Emma, 16 (b 1893/4), Estell, 13 (b 1896/7)
In the 1920 census, there is an entry for D. P. Smith, 73 (b 1846/7) b NY, father b NY,
mother b Penna, occ contractor, wife Allie, 63 (b 1856/7), b Tex., father b N.C.,
mother b Tex. With them is one child, Allie, 30 (b 1889/90).
In the 1930 census, there is an entry for Daniel P. Smith, 83 (b 1846/7), b NY, no
occ, father b Michigan, m b NY, age at first marriage 21 (1867/8), wife Allie, age 73 (b
1856/7), b Tex., both parents b N.C., age at first marriage 22 (1878/9), with them are
Estelle Smith, daughter, age 33 (b 1896/7) b Tex, secretary for water heater co.,
Mattie Thomson, age 50 (b 1879/80), step-daughter, widow, b. Tex., father b Ark, m b
Tex. [so she is probably Allie's daughter by Allie's first marriage], Mrs. Emma Atkinson,
daughter, age 36 (b 1893/4) b Tex., father b N.Y., mother b Tex., Lois Atkinson age
15 (b1914/5), b Tex.
On the other hand, I cannot find in the 1880 census a Daniel P. Smith married to an
Alice or Allie, just as I cannot find a Daniel P. Smith - Martha Jane Maule couple in
the 1900 or later censuses. The death date for Martha came from another descendant
of the Texas Maule branch, but otherwise I cannot find a death certificate for her. Did
she and Daniel divorce? Did she die? Is it possible that Alice (Allie) is Daniel's second
wife? The "age at first marriage" entry on the 1930 census suggests that's the case.
All of that would fit but for the absence of Garie on the 1880 census. Could they
simply have ignored or forgotten her?

I've included Garie's death certificate as well as her first husband's. The death date I
had for Daniel P. is 1933. The death certificate for him states that his wife's name is
Allie, not Martha. However, I have a death date of 1939 for Martha. I merged this
information from other trees so I don't know how accurate it is or if they divorced and
remarried. I couldn't find a death certificate for Martha. There is no image for Garie's
marriages. I hope this helps!
